1. About these terms

These terms of use (site rules) apply when you use BikesOnTheWight, a local motorcycle listings website for the Isle of Wight, available at bikesonthewight.co.uk. BikesOnTheWight is independently operated by Geoffrey Arthur.

By using the site, creating an account, or submitting a listing, you agree to these terms. They work alongside our Privacy Policy, which explains how we handle personal data.

2. What BikesOnTheWight is

BikesOnTheWight is a listing service. We help sellers publish adverts and help interested buyers contact sellers. We are not a dealer, broker, auction house, or party to any sale between users.

Any agreement to view, buy, sell, or exchange a motorcycle (or related item) is between the users involved, not with us.

At present the site is intended for ordinary private sellers and basic listings from local motorcycle businesses. If we introduce paid commercial accounts, promoted placements, or separate commercial terms in future, we will make those conditions clear when you sign up or purchase them.

3. Your responsibilities

If you use the site (including as a seller), you are responsible for:

  • Legal ownership and right to sell — you must own the bike or have authority to sell it, and comply with UK law (including documentation, taxes, and transfers where applicable).
  • Accurate listings — descriptions, photos, price, location, and contact details must be honest and not misleading.
  • Lawful conduct — you must not use the site for fraud, scams, harassment, or any illegal purpose.
  • Your messages — content you send through contact forms or email is your responsibility.

4. What we do not guarantee

We do not:

  • guarantee that any listing is genuine, available, roadworthy, or accurately described;
  • verify ownership, identity, condition, mileage, or history of any bike;
  • guarantee that a buyer or seller will complete a transaction or behave fairly;
  • provide mechanical, legal, or financial advice.

Viewing, meeting, inspecting, and buying are at your own risk. Take sensible precautions (for example meet in a safe public place, verify paperwork, consider an HPI or vehicle history check where appropriate, and consider an independent inspection before purchase).

5. Prohibited listings and conduct

You must not list, promote, or use the site for:

  • stolen vehicles, frames, or parts, or property you are not entitled to sell;
  • illegal or seriously non-roadworthy items offered in breach of law;
  • counterfeit parts or fraudulent schemes;
  • misleading adverts (false price, fake photos, bait-and-switch, impersonation);
  • spam, scraping, automated posting, or attempts to disrupt the site;
  • content that is abusive, discriminatory, or otherwise unlawful;
  • illegal content or activity, including unlawful threats, harassment, hate-based content, child sexual abuse material, terrorism-related content, or any other content or activity that is unlawful in the UK.

We may report serious suspected crime to the relevant authorities.

6. Moderation and enforcement

We may (but are not obliged to) review listings and accounts. We may edit, hide, refuse, or remove listings or content, suspend or close accounts, and limit features where we reasonably believe it is necessary to:

  • enforce these terms;
  • protect users and the public;
  • respond to reports or legal requirements;
  • reduce fraud, scams, or misuse.

Our decisions on moderation are generally final for use of the site. We are not obliged to give prior notice in urgent cases (for example obvious scams or illegal content).

Users can report suspicious, inaccurate, or unlawful listings, or concerning contact-seller enquiries, by contacting us at hello@bikesonthewight.co.uk. We will review reports as reasonably practicable but cannot guarantee a particular outcome or response time. We do not pre-screen every private message before it is sent.

7. Contact between users

When you contact a seller (or receive an enquiry), communication may be by email or other means outside our direct control. We do not guarantee delivery of messages and we do not monitor every private communication.

Do not send payment to strangers without appropriate checks. Be wary of requests to pay deposits via unusual methods, shipping scams, and pressure to act quickly.

8. Limitation of liability

To the fullest extent permitted by applicable law:

  • we provide the site on an “as is” and “as available” basis;
  • we are not liable for loss or damage arising from listings, user conduct, off-site dealings, or reliance on information on the site;
  • we are not liable for indirect or consequential loss (such as lost profit, lost opportunity, or distress), except where liability cannot be excluded under UK law.

Nothing in these terms excludes liability for death or personal injury caused by negligence, fraud, or other liability that cannot be limited by law.

9. Your content and our licence

You retain ownership of photos, text, and other material you submit. You confirm you have the right to post it and that it does not infringe anyone else’s rights.

By submitting content, you grant us a non-exclusive licence to host, display, store, and use it on BikesOnTheWight and in related communications to operate the service, until you or we remove it.

10. Accounts

You must keep login details secure and provide accurate registration information. You are responsible for activity on your account unless you tell us promptly if you believe it has been compromised.

We may suspend or close accounts that breach these terms or pose a risk to the site or other users.

11. Availability and changes

We may change, suspend, or withdraw parts of the site (including features) for maintenance, security, cost, or business reasons. We do not guarantee uninterrupted access.

We may update these terms from time to time. The “Last updated” date on this page shows when they were last revised. Continued use of the site after changes means you accept the updated terms.

12. Governing law

These terms are governed by the laws of England and Wales. Disputes relating to use of the site are subject to the courts of England and Wales, except where mandatory consumer rights require otherwise.
