We do not publish a postal address on this website. To exercise your data protection rights, please contact us by email.
2. What this policy covers
This privacy policy explains what personal data we collect when you use BikesOnTheWight, why we use it, who we share it with, how long we keep it, and your rights. Our Terms of Use sets out site rules for listings and accounts and applies alongside this policy.
We process personal data in line with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
3. Personal data we collect
We may collect and process the following:
- Registration (bike sellers): name, email address and password — to create and secure your account. We may send a verification email before your account is fully active.
- Bike listings: details you provide (make, model, year, mileage, price, town or area on the Island, description, photos) and seller contact details (name, email, and phone if you add one) — to publish and manage listings and allow buyers to contact you.
- Contact seller: your name, email and message when you enquire about a listing — to pass your message to the seller by email. We do not store the message body in the website database.
- Messages to us: details you send if you email us about the website.
- Technical data: login and session data, IP address, browser type, and similar information from our hosting, website software, and security tools.
4. Why we use your data and lawful bases
We use personal data only where the law allows, including:
- Contract — to provide services you request (creating your account, publishing and managing listings).
- Legitimate interests — to run and improve the website, respond to enquiries, deliver contact-seller messages, maintain security, prevent misuse, and enforce our rules, where those interests are not overridden by your rights.
- Legal obligation — where we must process data to comply with law.
- Consent — where we ask for your consent (for example non-essential cookies). You may withdraw consent at any time.
We do not sell your personal data.
5. Listings, accounts and moderation
We may review, moderate, edit or remove listings and related content, and restrict or close accounts, where we reasonably consider it necessary to comply with law, protect users, prevent fraud, or enforce our rules.
We may contact you about your account or a listing using the email address on your account or the details you provided.
6. Who we share data with
Personal data may be processed by our hosting and email service providers so we can run the site and deliver messages. We may also share personal data with:
- Service providers who help us run the website (hosting, email delivery, IT support), under appropriate terms.
- Email systems used to deliver contact-seller messages and account emails.
- Professional advisers where reasonably required.
- Authorities if required or permitted by law, or to protect the rights and safety of users and others.
7. International transfers
Our data is primarily processed in the United Kingdom and/or the European Economic Area. If we transfer personal data outside the UK/EEA, we will use an appropriate safeguard under UK data protection law.
8. How long we keep data
- Contact seller: not stored in the website database; retained in email systems according to our and recipients’ usual retention.
- Accounts and listings: while your account is active and for a reasonable period afterwards for backup, disputes, and legal compliance.
- Logs and security: for a limited period for security and troubleshooting.
9. Security
We use appropriate technical and organisational measures to protect personal data. No online service is completely secure.
10. Your rights
Under UK data protection law you may have the right to access, rectify, erase, restrict, or object to processing, data portability, and to withdraw consent where processing is based on consent.
To exercise these rights, email us at the address in section 1. We may need to verify your identity.
If you are not satisfied with how we handle your data, you may complain to the Information Commissioner's Office (ICO): ico.org.uk/make-a-complaint.
11. Cookies
At present we use only cookies and similar technologies that are strictly necessary for the site to work (for example keeping you logged in and securing forms). We do not currently use analytics or advertising cookies.
If we introduce optional cookies (such as analytics), we will update this policy and ask for consent where UK law requires it. You can control cookies in your browser settings.
12. Website and your content
We own or license the website, its design, branding, software, and databases. You may use the site for personal purposes in line with this policy and any separate terms we publish.
You are responsible for content you submit (listing text and images). By submitting content, you grant us a licence to host, display, and distribute it on BikesOnTheWight and related communications to operate the listings service, until you or we remove it. You confirm you have the right to grant that licence.
13. Children
This website is not directed at children under 16. We do not knowingly collect personal data from children. If you believe we have done so, please contact us and we will delete it.
14. Automated decision-making
We do not use solely automated decision-making that produces legal or similarly significant effects concerning you.
